Terms of Service
Trocaly, operated by Floyd Xiao as a sole proprietor in Ontario, Canada.
1. What Trocaly is
Trocaly is a members-only exchange community. Members give goods and skills to each other, earn credits for giving, and spend credits to receive. Rides are not yet offered; they will be added later. Trocaly is a platform, not a party to exchanges between members. Trocaly does not guarantee that any particular item or service will be available.
2. Membership and fees
- Trocaly is for adults (18+). One account per person; accounts are not transferable. Trocaly is not yet available in Nevada, California, Arizona, Washington or New York.
- Joining and listing are free.
- A small service fee is charged to the member who claims, only when an exchange completes: 1% of the exchange's credits, with a minimum of $1 and a maximum of $30, charged in the member's own currency at the same amounts. Claims under 50 credits carry no fee. Every claim of 50 credits or more carries the fee, from a member's very first claim. No fee is charged when an exchange is cancelled or a member does not show up, and if the credits are returned in full, the fee is refunded too. If only part of the credits are sent back after a review, the fee stays as charged, because the exchange did complete in part.
- Service fees are not being collected yet. The fee applies only once fee collection is switched on, and members will be told in the app at least 30 days before that happens. An exchange that was opened before fee collection is switched on stays free, even if it completes afterwards — and fees are never charged on exchanges already completed.
3. Credits
- Credits have no cash value. They cannot be bought, sold, transferred to another person, exchanged for money, or redeemed for anything outside Trocaly. They are not cryptocurrency.
- Credits are created only when an exchange is completed.
- When you claim something, the agreed credits are taken from your balance right away and kept safe by Trocaly. When the giver marks the exchange done, the credits go to the giver 24 hours later — sooner if you tap "Confirm receipt" — unless you report a problem first. If the exchange does not happen, the credits are returned in full.
- If the giver never marks an exchange done within 14 days of the claim, the credits are returned automatically. After credits have been paid to a giver, a problem can still be reported for 14 days; if Trocaly's review upholds the report, some or all of the credits are sent back, and the giver's balance may go negative (see the credit-line rule below) until it is worked back by giving.
- New members start with 0 credits and receive a credit line (they can claim up to 100 credits ahead of earning; after the first completed exchange the line grows to 300, and after five completed exchanges — each with a different member — it grows to 500. A confirmed no-show or a problem report upheld against you pauses the growth) so they can receive before they have given. A negative balance must be worked back by giving; a member who leaves with a negative balance may have their membership reviewed. If a send-back takes your balance below zero, your credit line is frozen until your balance is back to zero or above.
- Trocaly may adjust the credit system to protect the community (for example, freezing a credit line after repeated no-shows). Credits never expire while a membership is active.
4. Exchanges between members
- Members set their own asking credits and may discuss them in messages; only the member who posted a listing can change its price, and claims always go at the current asking credits. Trocaly does not set prices.
- Never tap "Confirm receipt" for an exchange that did not happen or was not as described — and if a giver marks an exchange done that never happened, report it within the 24 hours. That report is what stops the credits.
- No-shows: if a member does not show up and did not reschedule beforehand, the exchange is cancelled and held credits are returned. The reported member is notified and has 7 days to respond or dispute; the no-show is recorded on that member's profile only after those 7 days, or when a dispute is decided. Three confirmed no-shows freeze the member's credit line and flag the account for review; the account may also be suspended. If the member who claimed is the one who didn't show up, then once the no-show is confirmed the member who waited receives 5 credits from the exchange — taken only from credits the claimer had already earned, never from their credit line.
- Members are responsible for their own safety at in-person exchanges: meet in public places where practical, and use the in-app report tools for any problem.
5. What can never be exchanged
Food and drinks; alcohol, cannabis, tobacco, and vapes; illegal drugs and drug equipment; medicines, supplements, and vitamins; weapons, ammunition, and pepper spray; fireworks and other explosives; hazardous chemicals, pesticides, and fuels; damaged, swollen, or leaking batteries; anything that has been recalled or is banned in Canada — including baby walkers, drop-side cribs, and inclined sleepers; used baby car seats and cribs; used helmets; opened, used, expired, or homemade cosmetics and personal-care products; counterfeit goods; gift cards and event tickets; live animals; sexual services; and services that legally require a licence (such as medical or legal advice, or electrical and gas work). One rule covers everything else: never list anything that is damaged in a way that could make it unsafe, or used safety gear whose condition you can't be sure of, like life jackets or climbing gear. If you're not sure it's safe, don't list it. Trocaly may remove any listing at its discretion.
6. Rides
Rides are not yet offered on Trocaly. Terms for rides will be added here before rides launch.
7. Acceptable use
No fraud, fake listings, fake accounts, harassment, or using Trocaly to arrange anything illegal. Trocaly may suspend or end a membership for conduct that harms the community, without refund in cases of fraud or abuse.
8. Complaints and enforcement
- Reporting a problem. If something goes wrong — a no-show, an item or service not as described, unsafe or abusive behaviour — report it in the app: tap "Something's wrong" on the exchange (in Exchanges), or "Report this listing" on any listing. For anything else, email support@trocaly.com. Reports about an exchange are usually one of these: a member did not show up; an item or service was not as described or was done badly; an exchange was marked done but never happened; or a safety concern. Credits connected to a reported exchange stay where they are while the problem is reviewed — if they have not been paid out yet they stay put, and if they have, they can be sent back.
- How review works. Trocaly reads the report and may review the exchange record and the messages sent through the app about it (see the Privacy Policy). Trocaly may ask either member for their side, and aims to decide within 7 days of the report. Trocaly may return the credits in full, split them between the members, or leave them where they are.
- The enforcement ladder. For most problems, enforcement climbs in steps: a reminder or warning → a strike on the member's record → a frozen credit line → suspension → membership ended. Trocaly may skip steps and suspend or end a membership immediately for fraud, fake accounts, harassment, threats, illegal use, or anything that puts another member's safety at risk.
- Your chance to respond. When Trocaly takes an enforcement step — a warning, a strike, a frozen credit line, a suspension, or ending your membership — the step takes effect immediately, and a suspension or an ended membership signs you out at once. At that same moment, you will be told the reason by in-app notice and email. You have 7 days from when that notice is sent to respond by emailing support@trocaly.com. The step stays in effect unless Trocaly changes it. Trocaly will read your response and may change the decision, including restoring your membership, if your response shows the decision should change.
- Fairness. The rules are enforced based on conduct only. Trocaly never suspends or ends a membership because of a member's race, ancestry, place of origin, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity or expression, age, marital or family status, or disability.
- Refunds and credits on removal. If a membership is ended for fraud or abuse, a service fee charged for a completed exchange is not refunded (see section 2). Otherwise, the refund rules in section 2 apply. Held credits under review are decided as part of the review; earned credits are never paid out in cash in any case (see section 3).
- Records. Trocaly keeps records of reports, warnings, and decisions so the rules are applied consistently (see the Privacy Policy).
- Emergencies. If anyone is in danger, call 911 first, then report it in the app. Trocaly may share information with authorities where the law requires or safety demands it.
- Trocaly's decision after review is final within the service.
Trocaly does not verify any member's skills, qualifications, or experience, does not run background checks, and does not insure exchanges. Each member is responsible for describing what they can do honestly, agreeing what a job includes before starting, and doing the work safely.
9. Liability
Members exchange with each other at their own risk. To the maximum extent permitted by law, Trocaly's liability for any claim is limited to the service fees you paid in the 12 months before the claim. Nothing in these terms limits rights you have under Ontario consumer law.
10. Changes and governing law
Trocaly may update these terms; material changes will be announced in the app before they apply. These terms are governed by the laws of Ontario and Canada.
